General Terms and Conditions (GTC)

1. Scope and contracting parties

1.1 Operator

These General Terms and Conditions apply to the use of the online platform robothub24.ch (hereinafter “the platform”). The platform is operated by:

1.2 Applicability

These GTC apply to all users (hereinafter “users”) of the platform, in particular to sellers and buyers of robots and robotics components. By registering on robothub24.ch, users declare their acceptance of these GTC.

1.3 Contract language

The platform is currently offered in German; further languages (French, Italian, English) will follow. In the event of contradictions between the language versions, the German version of these GTC is authoritative.

1.4 Amendments

The operator of robothub24 reserves the right to amend these GTC at any time. Users are informed of material changes by email at least 30 days before they take effect. Continued use of the platform after amended GTC take effect constitutes acceptance.

2. Platform services

2.1 Marketplace

robothub24.ch is a Swiss online marketplace for buying and selling new and used robots as well as robotics components. robothub24 is not itself a seller and acts exclusively as an intermediary between sellers and buyers.

2.2 Escrow service (optional)

robothub24 provides an optional escrow payment service. The purchase price is initially held in trust after receipt of payment and only paid out to the seller after confirmed handover of the purchased item. Use of the escrow service is voluntary for the buyer. If the escrow service is waived, the associated buyer protection does not apply.

2.3 Platform fee

robothub24 charges a platform fee in accordance with the current price list published at robothub24.ch/preise. Users are informed of price changes by email at least 30 days in advance.

2.4 Prohibited-items list

robothub24 maintains a separate, regularly updated prohibited-items list at robothub24.ch/verbotsliste. This list is an integral part of these GTC.

3. Registration and user account

3.1 Requirements

Use of the platform requires registration. Natural persons aged 18 or over as well as legal entities are entitled to register, provided no local legal prohibitions apply.

3.2 User obligations

Users are obliged to provide complete and truthful information, to keep their password secret, not to transfer their account to third parties and to inform robothub24 immediately of security incidents.

3.3 Seller categories

robothub24 distinguishes between private and commercial sellers. Commercial sellers must identify themselves as such and comply with applicable consumer protection law.

3.4 Right of withdrawal for commercial sellers

If a consumer buys from a commercial seller, they are entitled to the statutory rights of withdrawal. The withdrawal period is 14 days from receipt of the goods. For private-to-private sales there is no statutory right of withdrawal.

3.5 Sanctions

In the event of violations, robothub24 reserves the following measures: written warning, temporary or permanent suspension, removal of listings without refund, as well as civil or criminal action.

4. Listings

4.1 Posting a listing

Listings must fully state the manufacturer, model, year of construction, serial number, at least 3 photos, condition and all known defects.

4.2 Listing types

  • Fixed-price listing: binding purchase price, active until sale or expiry.
  • Auction listing: starting price + duration of 7, 14 or 30 days. Bids placed are binding.
  • Buy-now price: optional price in auctions; its acceptance ends the auction immediately.

4.3 Offer duration

Listings are active for 60 days from the publication date. After expiry, the listing is automatically deactivated. Permanently inactive listings (>180 days) are automatically deleted.

4.4 Prohibited listings

  • Military systems, weapon systems or combat robots
  • Stolen or unlawfully acquired goods
  • Goods requiring an export licence (e.g. dual-use goods under the GCA)
  • Duplicates or multiple listings of the same item

4.5 Off-platform prohibition

It is prohibited to settle deals initiated via the platform outside of it in order to circumvent fees. Violations may lead to immediate account suspension.

5. Purchase process and payment handling

5.1 Conclusion of contract

The purchase contract is concluded exclusively between buyer and seller. robothub24 is not a contracting party.

A purchase concluded via the platform is, under Swiss law, a legally binding contract within the meaning of Art. 1 et seq. and Art. 184 et seq. of the Code of Obligations (CO). With the acceptance of a fixed-price offer, the award in an auction or the confirmation of the purchase request, a binding contract arises that obliges both parties to perform.

5.2 Escrow process

  1. Buyer makes a purchase request and selects the escrow service
  2. Buyer transfers the purchase price and the escrow fee to the escrow account
  3. Seller is informed of the receipt of payment and ships the goods
  4. Buyer confirms receipt and conformity within 5 working days
  5. After confirmation, the purchase price is paid out less the platform fee

5.3 Missing confirmation

If the buyer does not confirm receipt within 5 working days and no dispute is open, the payment is automatically released.

6. Dispute resolution

In the event of disputes, both parties can report a dispute via the platform. robothub24 makes a decision within 10 working days. For EU consumers: ec.europa.eu/consumers/odr

7. Liability, warranty and AI-generated content

Part of the content published on the platform, in particular images, product descriptions, fact sheets and editorial articles, is created or prepared with the help of artificial intelligence systems. Such content is editorially reviewed and approved before publication; editorial responsibility lies with HIT Management AG. Content created or edited with the help of AI is labelled where this is legally required or appropriate for transparency.

Despite careful review, content created with the help of AI may contain errors, inaccuracies or outdated information. robothub24 accepts no warranty for the correctness, completeness, reliability and timeliness of the information provided, including editorial articles, fact sheets, technical details and AI-generated content. All content serves general information purposes and does not constitute legal, technical, financial or investment advice.

robothub24 is not liable for the correctness of listings, the performance of purchase contracts or damage arising from direct payments made outside the escrow service. Liability is limited to the amount of the platform fee charged in the transaction in dispute.

Users may only upload content (in particular images, texts and descriptions) for which they hold the necessary rights or have obtained the corresponding permission. The uploading user is solely responsible for content uploaded by users. robothub24 accepts no liability for copyright or other infringements of protective rights arising from content uploaded by users. The user indemnifies robothub24 against justified claims of third parties arising from such an infringement. robothub24 does not systematically review content in advance, but removes or blocks it without delay as soon as it becomes aware of an infringement. Illegal content can be reported at any time via the reporting function on each listing.

8. Applicable law and place of jurisdiction

These GTC are subject to Swiss law. The place of jurisdiction is Zug, Switzerland, to the extent legally permissible.

9. Final provisions

Should individual provisions be invalid, this does not affect the validity of the remaining provisions.
